1.     ACCEPTANCE

2.     DESCRIPTION OF SERVICE AND CONTENT POLICY

We serve as an online marketplace where users who follow our Terms of Use can buy, sell, and offer various products and services listed on the website. While you can make payments and conduct transactions through the website (using third-party services like Easypaisa and JazzCash), Shahgi itself is not directly involved in these transactions. It’s essential to understand that Shahgi doesn’t control any part of these transactions, and it has no liability for them. You use the Service and the Website at your own risk.

You know that Shahgi doesn’t control or take responsibility for ads, business listings, messages between users, or any other stuff you might see on the website. This means you might come across things like ads or messages that are rude, wrong, or just not good. You understand that it’s up to you to decide if you want to use or believe any of that stuff, and that Shahgi isn’t responsible if you have any problems because of it.

Regarding the content you share through the Service, you confirm and acknowledge that:

i) You’ve created the content, like descriptions and/or photos, following Shahgi’s instructions on the website. Any copyrights to this content belong to Shahgi, and if you’re considered to own any copyright, you’re giving it to Shahgi.

ii) You understand that Shahgi stores and organizes the information and/or photos you post on the website in its own database. Shahgi modifies this uploaded content by adding its logo watermark, and the copyright for these modified works also belongs to Shahgi.

iii) As long as the content is available on the website, you must have the necessary permissions to use it there. This includes any patents, trademarks, copyrights, or other rights in the content. You also authorize Shahgi to exclusively use this content as needed for the Service and the website.

iv) You’ve obtained written consent from every identifiable individual or business depicted in the content to use their name or likeness as described in these Terms.

When you submit content to the website, you’re granting Shahgi an irrevocable, perpetual, worldwide, exclusive, royalty-free license to use, reproduce, distribute, and display the content for Shahgi’s business purposes, including promoting the website. Additionally, by posting content publicly, you grant Shahgi exclusive rights to control how that content is used or displayed on the Service or the Website, including the right to take legal action under copyright and other laws of Pakistan. You’re also giving every user of the website permission to view your content there, but this permission ends if you or Shahgi removes or deletes your content from the website.

Shahgi doesn’t support any content or the opinions, statements, recommendations, or advice expressed in it, and Shahgi isn’t responsible for any user content. Shahgi doesn’t allow copyright infringement or violations of intellectual property rights on the website. If Shahgi is properly notified that content infringes on someone else’s rights, Shahgi may remove it at its discretion. Shahgi can also remove any content without warning and may block a user’s access to the website if they repeatedly infringe copyrights or violate these terms. A repeat infringer is someone who has been warned about copyright violations or has had content removed multiple times. Shahgi also has the right to decide if any content follows these terms.

If you upload photos for your ad, Shahgi might offer you a video service. By uploading your photos, not covered in the previous sections, you’re giving Shahgi an irrevocable license to exclusively use them for this service. You confirm that you own all the necessary rights to upload and use the photos for this purpose. With this service, Shahgi might create a video using a third-party application or service. Shahgi may then upload the video on platforms like YouTube, chosen at Shahgi’s discretion, and embed it into your ad on Shahgi’s platform.

3.     BUMP UP / FEATURED ADS

Shahgi might provide a service called “Bump Up / Featured Ads,” allowing users to pay a non-refundable fee to have their ads featured in specific spots on the website, potentially increasing their visibility. To buy a Featured Ad, you might need to send certain details through a third-party service provider, which has its own terms and policies. Shahgi can’t ensure the safety or security of the information you send to any third-party service provider. If you link to a third-party service, you’re doing so at your own risk, and Shahgi isn’t responsible for any issues that may arise.

4.     CONDUCT

You agree not to share any information on the Website that:

Breaks any laws or regulations.

Is protected by copyright, patent, trade secret, trademark, or other intellectual property rights, unless you own those rights or have permission to share the material and grant Shahgi the necessary license rights.

Infringes on the intellectual property rights of others or violates any law, regulation, or contractual relationship.

Is harmful, abusive, unlawful, threatening, harassing, defamatory, obscene, pornographic, and libelous, invades privacy, promotes illegal activities, or harms minors in any way.

Harasses, intimidates, or shows hate towards individuals or groups based on religion, gender, sexual orientation, race, ethnicity, age, or disability.

Violates equal employment laws by stating preferences or requirements based on race, color, religion, sex, national origin, age, or disability in job advertisements.

Shares personal or identifying information about someone without their explicit consent.

Pretends to be someone else or misrepresents affiliations.

Deceives or threatens the recipient or contains offensive content.

Is false, deceptive, misleading, or a “bait and switch” offer.

Involves illegal schemes, spam, chain letters, or unsolicited advertisements.

Advertises in unauthorized areas of the website or contacts users who have opted out of such communications.

Includes links to commercial services or third-party websites without Shahgi’s permission.

Promotes illegal services or the sale of prohibited or restricted items.

Contains viruses or other harmful computer code.

Disrupts normal communication on the Service or negatively affects other users’ experiences.

Uses misleading email addresses or manipulated identifiers to disguise the origin of shared content.

Furthermore, you agree not to:

Contact anyone who has requested not to be contacted or engage in unsolicited contact for commercial purposes, such as soliciting users to post ads on third-party websites or posting ads on behalf of others, or engage in stalking or harassment.

Make any statements or postings that are defamatory or libelous against any individual.

Gather personal data about other users or entities for unlawful or commercial purposes.

Use automated tools like spiders, robots, crawlers etc. to download or scrape data from the Service, except for legitimate internet search engines and non-commercial public archives.

Post content that is irrelevant to the local area, repeatedly post similar content, or overload our servers and infrastructure unreasonably.

Duplicate postings across multiple categories or locations.

Attempt unauthorized access to Shahgi’s computer systems or disrupt, impair, or interfere with the Service or Website’s performance or functionality.

Utilize any automated tool that bypasses Shahgi’s flagging system or community control systems, or use such tools to remove posts of competitors or other parties without genuine belief that the post violates the Terms or applicable laws.

Employ any automated device or software for submitting posts on Shahgi without human involvement, including bulk postings or automatic submissions at specific intervals.

Understand that any content you upload must comply with relevant laws and may be disabled or investigated under appropriate laws. Non-compliance with laws, regulations, these terms, or the site’s privacy policy may result in termination of your account or access to the site, and we reserve the right to remove any non-compliant content uploaded by you.

5.     PAID POSTINGS

Shahgi might require a fee for posting content in certain parts of the Service, known as “Paid Posting.” This allows specific content to be displayed in a designated section of the website for a set duration. Each party posting content is accountable for it and must adhere to the Terms. The fee for Paid Posting is non-refundable, whether the content isn’t used during the agreed period or if it’s removed for violating the Terms. Paid Posting fees can’t be transferred to another posting or adjusted against another Paid Posting, and they can’t be transferred between users.

6.     POSTING AGENTS

In this context, “Posting Agent” refers to a third-party entity that posts content to the Service for others. Shahgi strictly prohibits the use of Posting Agents, whether directly or indirectly, without explicit written consent. Posting Agents are not allowed to post content for others or access the Service for posting on behalf of others without written permission or a license from Shahgi. Any permission granted by Shahgi to a Posting Agent is not transferable or assignable.

7.     LICENSE TO ACCESS THE SERVICE

Shahgi gives you a limited, revocable, non-exclusive license to use the Service for personal purposes. However, this license doesn’t include:

Access or use of the Service by Posting Agents.

Any collection, aggregation, copying, duplication, reproduction, display, or derivative use of the Service, or using data mining tools, robots, spiders, or similar methods to gather information, unless expressly allowed by Shahgi or stated otherwise in these Terms.

Exceptions are made for general internet search engines and non-commercial public archives that gather information solely for displaying hyperlinks to the Service, provided they comply with certain conditions.

Under this license, you can display individual postings from the Service on your website or create hyperlinks to them for non-commercial or news reporting purposes only. However, if you display more than ninety-nine postings, it’s considered a violation of the Terms unless expressly permitted by Shahgi. Hyperlinking to the Website’s homepage is allowed as long as it doesn’t misrepresent Shahgi or its affiliates.

Any use of the Service beyond what’s authorized in these Terms terminates the granted license immediately. To use the Service for other purposes, including commercial ones, you need to obtain a separate license from Shahgi.

8.     NOTIFICATION OF CLAIMS OF INFRINGEMENTS

Shahgi holds no responsibility for any copyright or intellectual property rights violations resulting from materials posted or transmitted through the site, or from items advertised on the site by end users or third parties.

If you own intellectual property rights or are authorized to act on behalf of the owner and believe that any content infringes upon those rights, you can submit a notification to Shahgi requesting the removal of the relevant content in good faith. Your notification should include:

A physical or electronic signature from a person authorized to represent the owner of the exclusive right purportedly infringed.

Identification of the intellectual property rights claimed to be infringed, or, if multiple rights at a single online site are covered, a representative list of such works.

Identification of the infringing content (such as through a data link or AD ID) and information to help Shahgi locate it.

Contact information, including address, telephone number, and email address if available.

A statement signed by you affirming your good faith belief that the material’s use is unauthorized by the intellectual property right-owner, agent, or the law.

A statement holding Shahgi harmless from any third-party claims related to the removal of the content.

A statement signed by you, under penalty of perjury, affirming the accuracy of the information provided and your authorization to act on behalf of the exclusive right-owner.

9.     INTELLECTUAL PROPERTY RIGHTS

You recognize and consent that the materials found on the Website, excluding the user Content you licensed to Shahgi under Section 2(3) of the Terms, such as text, software, scripts, graphics, photos, sounds, music, videos, interactive features (“Materials”), and the trademarks, service marks, and logos (“Marks”) contained therein, are either owned by or licensed to Shahgi. These materials are protected by copyright and other intellectual property rights under Pakistani laws, international treaties, and conventions.

Certain trademarks belonging to third parties may be displayed on the Website, and their use may be subject to licenses granted by these third parties to Shahgi. You are not permitted to reverse engineer, decompile, or disassemble such trademarks, and nothing in this agreement grants you rights regarding these trademarks.

The Materials on the Website are provided to you “AS IS” for your personal use and information only. You may not use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or exploit them for any other purposes without prior written consent from the respective owners. Shahgi reserves all rights not expressly granted herein to the Website and the Materials.

You agree not to engage in unauthorized use, copying, reproduction, or distribution of the Materials, including any third-party Materials obtained through the Website, for commercial purposes. If you download or print Materials for personal use, you must retain all copyright and other proprietary notices. You also agree not to bypass, disable, or interfere with security features of the Website or features that prevent or restrict the use or copying of any Materials.

The Service is protected by copyright laws, other laws of Pakistan, and international treaties and conventions. Content displayed on or through the Service is protected by copyright as a literary work, collective work, and/or compilation. Reproduction, modification, creation of derivative works, or redistribution of the Website, Materials, or collective work or compilation, or allowing others to do so, is expressly prohibited.

You may not reproduce, duplicate, copy, sell, resell, or exploit any aspect of the Service for commercial purposes.

10.     USER SUBMISSIONS

You acknowledge that while using the Website, you’ll encounter Content from various sources, and Shahgi is not accountable for the accuracy, usefulness, safety, or intellectual property rights concerning such Content. Additionally, you understand and accept that you might come across Content that is inaccurate, offensive, indecent, or objectionable, including defamatory or libelous material. 11.     INDEMNITY

You agree to protect, indemnify, and hold harmless Shahgi, its officers, subsidiaries, affiliates, successors, assigns, directors, agents, service providers, suppliers, and employees from any claims, damages, obligations, losses, liabilities, costs, or debts, including attorneys’ fees, arising from:

Your use of the Website and/or the Service.

Your violation of any provision of these Terms.

Your infringement of any third-party rights, including but not limited to copyright, trademark, other intellectual property rights, trade secrets, or privacy rights.

Any assertion that your Content resulted in harm to a third party.

This obligation to defend and indemnify shall remain in effect even after the termination, modification, or expiration of these Terms and your use of the Service and the Website.

12.     NO SPAM POLICY

You acknowledge and consent that sending unsolicited email advertisements or other communications to Shahgi email addresses or through Shahgi computer systems is strictly prohibited by these Terms. You understand and agree that Shahgi may occasionally monitor email usage, either through human monitors or automated software, to identify certain words associated with spam or scams in emails exchanged within the Shahgi email system. Any communication between you and another user using the communication features provided by the Service and the Website must adhere to the Terms. Unauthorized use of Shahgi computer systems constitutes a violation of these Terms and certain applicable laws. Such violations may result in civil and criminal liabilities and penalties for the sender and their agents.

13.     DEALINGS WITH ORGANIZATIONS AND INDIVIDUALS

You recognize and consent that Shahgi is not responsible for your interactions with any organizations or individuals on the Website or through the Service. This encompasses activities such as payment and delivery of goods and services, as well as any terms, conditions, warranties, or representations associated with such interactions. These transactions are solely between you and the respective organizations or individuals. You agree and acknowledge that Shahgi bears no responsibility or liability for any losses or damages incurred as a result of these interactions. In the event of a disagreement between participants on the Website or between users and any third party, you acknowledge and accept that Shahgi is not required to intervene in such disputes. In the event of a dispute with one or more other users, you hereby release Shahgi, its officers, employees, agents, and successors from any and all claims, demands, and damages (both actual and consequential) of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising from or related to such disputes and/or our Service.

14.     LIMITATION AND TERMINATION OF SERVICE

You recognize and consent that Shahgi may, at its discretion, set limitations on the use of the Service, including but not limited to, the maximum duration for which Content will be retained, the maximum quantity and size of postings, emails, or other Content that may be transmitted or stored, and the frequency of access to the Service or the Website. You acknowledge and agree that Shahgi bears no responsibility or liability for the deletion or failure to store any Content transmitted or maintained by the Website or the Service. Furthermore, you acknowledge and agree that Shahgi reserves the right, at any time and without prior notice, to modify or discontinue the Service (or any part thereof), and Shahgi shall not be liable to you or any third party for such modifications, suspensions, or discontinuations. You also acknowledge and agree that Shahgi, at its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or terminate your access to or use of the Service (or any part thereof), immediately and without notice, and to remove and discard any Content within the Service, for any reason or no reason at all, including, but not limited to, if Shahgi believes you have violated these Terms. Our failure to take action regarding a breach by you or others does not waive our right to address subsequent or similar breaches by you or others. Despite the aforementioned provisions or any other provision in these Terms, shahgi retains the right to pursue legal and equitable remedies, including but not limited to, enforcing any term contained in these Terms, seeking a preliminary or permanent injunction against any actual or threatened breach of such term, or in support of the exercise of any power granted in these Terms, individually or collectively, without the necessity of posting a bond.
